Armandi Events & Travel Management is a business in the travel and tourism industry that has its operations in Cape Town, South Africa.

Booking and Payments

1.1 All packages, tours & event bookings require a booking/deposit fee or full payment before the booking will be confirmed. The booking is only confirmed when you receive an email from us with a booking confirmation. If you paid for a tour, event, booking or travel package and did not receive a confirmation within 24 hours from the purchase, it remains the responsibility of the client/traveller to contact our help desk. Specified layby installments on selected packages that offer any payment plan should be paid on/by the specified date of every calendar month on our website via your choice of payment options available.

1.2 Defaulting on a payment or missing a layby installment will result in immediate cancellation and all monies paid up to the cancellation date will not be refunded.

In the event of technical errors on our website that may affect your payment ability, will be attended to and payments will then become due immediately once corrected/fixed. It remains the client/travellers responsibility to make regular payments to ensure the booking stays active. Any payment extension of any sort will not be allowed under any circumstances.

1.3 Defaulting on payment or skipping one layby installment will result in a penalty fee of $50 (fifty American dollars) added to your next payment, the arrears amount along with the penalty fee should be settled within 3 (three) working days from the default payment date, thereafter the booking, tour, event or package will be cancelled immediately without any refund.

1.4 When you click to make a purchase with us legal obligations arise and your right to the refund of monies charged to your credit card or paid in any other way agreed by us, are limited by our refund policy. Do not make any purchase through our website unless you understand and agree to all our terms and conditions / policies.

1.5 Once payment is made for the purchase, it is deemed that you have read and understood the terms and conditions / policies and also agree to all our terms and conditions & Policies. You then also warrant that you made contact with the South African Embassy beforehand to ensure that you are able to obtain a Visa/Travel documentation for the specified date of the tour, package, event or booking before making the purchase. Armandi Events & Travel Management are not responsible or reliable in any way with this regard.

1.6 Payment options accepted Payment may be made via Visa, MasterCard, Diners or American Express Cards or by bank transfer into the Armandi Events & Travel Management’s bank account, the details of which will be provided on request.

1.7 Card acquiring and security Card transactions will be acquired for Armandi Events & Travel Management via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

1.8 Customer details separate from card details Customer details will be stored by Armandi Events & Travel Management separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

1.9 Merchant Outlet country and transaction currency The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

1.10 Armandi Events & Travel Management takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Book Now & Pay Later

2.1 This signed Authority and Mandate refers to our agreement with the client referred to “I/We/Our/My/Me/Us/You” dated as on signature hereof (“the Agreement”).

2.2 I / We hereby authorize Armandi Events & Travel Management to issue and deliver payment instructions to the bank for collection against my / our above mentioned / bank card/ account at my / our above mentioned bank (or any other bank or branch to which I / We may transfer my / our account) on condition that the sum of such payment instructions will never exceed my / our obligations to Armandi Events & Travel Management, and commencing on the commencement date and continuing until this Authority and Mandate is terminated by me / us by giving you notice in writing of no less than 1 CALENDAR MONTH.

2.3 The individual payment instructions so authorised to be issued must be issued and delivered as follows: Monthly; on or the 1ST OF EVERY MONTH when the obligation in terms of my agreement with Armandi Events & Travel Management (Pty) Ltd is due and the amount of each individual payment instruction may not be more or less than the obligation due.

2.4 I / We understand that the withdrawals hereby authorised will be processed through a computerized system provided by the South African Banks / or a financial services provider for/of Armandi Events & Travel Management and I also understand that details of each withdrawal will be printed on my bank statement. I / We shall not be entitled to any refund of amounts which you have withdrawn while this authority was in force, if such amounts were legally owing to Armandi Events & Travel Management (Pty) Ltd.

2.5 MANDATE I / We acknowledge that all payment instructions issued by you shall be treated by my/our above mentioned bank as if the instructions had been issued by me/us personally.

2.6 CANCELLATION I / We agree that although this Authority and Mandate may be cancelled by me / us, such cancellation will not cancel any agreement/s with Armandi Events & Travel Management (Pty) Ltd. I / We shall not be entitled to any refund of amounts which you have withdrawn while this authority was in force, if such amounts were legally owing to Armandi Events & Travel Management (Pty) Ltd.

2.7 ASSIGNMENT I / We acknowledge that this Authority and Mandate has been accepted by the me/us and I/We give Events & Travel Management (Pty) Ltd and its financial advisors/ bank full permission/authorisation to debit my bank account/card ON THE 1ST OF EVERY MONTH until all owing funds are paid up in full. I /We agree that the complete POPI Act clause as set in section 15 of our terms and conditions agreement.

Itineraries

3.1 Meals, Accommodation, Activities and Sight seeings are only included as specified in the detailed itineraries of all our packages/tours. All exclusions are clearly mentioned and it is your responsibility to read and understand our policies and tours before confirming your purchase.

3.2 Our timetables, tours and itineraries are subject to change without prior notification. All packages,tours and activities are weather dependent. Armandi Travels reserves the right to change the routes, activities, hotels, transport, meals and any specified / unspecified itinerary on our packages/tours without prior notices. We do not expect any liability for wrongly booked Airline Tickets, delayed flights or flight cancellations. In this event, no refunds of any sort will be granted.

3.3 Travellers are picked up and dropped off at the hotels,venues, attractions and or activities as specified on the itinerary of all our packages / tours where transport is included or specified only.If it is not specified or included additional transportation charges will apply. In the event of a transport problem or running behind schedule due to traffic, technical problems or road works, every attempt will be made to keep all travellers informed. In the event that any of our planned / scheduled activities are cancelled without prior notice from our suppliers or governmental / private parks we will try and arrange a replacement activity or schedule something else for that specific day. If in any event we are not able to arrange anything , we will not be liable for any loss or damage it may cause, no refunds will be paid for any loss of entrance fees or costs related to the above mentioned. We accept no liability for any inconvenience in this regard.

Passports & Visas

4.1 It remains the traveller/clients responsibility to have a valid passport and all visas, permits, vaccinations, certificates and travel & medical insurance required for your selected travel routes / packages.

4.2 Costs of visas, passports and flights are excluded from any and all tours / packages unless otherwise specified in writing. It is the responsibility of each client/traveller to ensure and obtain any and all visas required for the countries to be visited while on any of our tours.

4.3 Armandi Events & Travel Management or its tour operators will not pay for or provide any further transport, assistance or alternative arrangements to any client/traveller who is not allowed to enter a country because of not having obtained the required visa or required documents.

4.4 Clients/travellers must have personal comprehensive travel insurance covering cancellation, curtailment, medical, emergency trail and personal accidents. No refunds may be claimed in the above mentioned regards from Armandi Travels.

Medical Conditions & Dietary Requirements

5. All dietary requirements,allergies, underlying medical conditions or requests of any nature should be mentioned on our booking platform where indicated. Armandi Events & Travel Management , its servants,its agents and suppliers shall not be responsible for and shall be exempt from all liability in respect of any Medical Conditions that may arise during any of our tours/travel packages. It remains the responsibility of the traveller/client to ensure they disclose any/all medical or allergy conditions to Armandi Events & Travel Management prior to their purchase. It remains the client/travellers responsibility to ensure that he/she does not participate in any event,activity, meals or circumstances that may affect any underlying medical, health, allergy or fiscal condition/ abilities of the traveller/client.

Alcohol & Substance Abuse

6.1 Drinking alcohol on any of our tours are subject to the laws of the country/government the tour, booking or packages are operating in. The legal drinking age will be determined by the applicable countries law and the client/traveller warrants that he/she will abide by the law at all times.

6.2 No drugs of any sort, unless prescribed, will be allowed on any of our tours, bookings or travel packages. In the event of any substance abuse, Armandi Travels reserves the right to cancel the tour, package or booking immediately without any notices. We are not liable for any loss or damage it may cause, no refunds will be paid related to the above mentioned. We accept no liability for any inconvenience in this regard. We reserve the right to pursue legal action in the event of substance abuse or anything of a violent nature.

Refunds & Cancellations

7.1 Should the traveller fail to join a tour, booking or package, or join it after departure or leave it prior to its completion, no refunds will be made whatsoever. All our tours / packages are non-refundable, refunds are to be claimed from the clients/travelers personal travel insurance companies.

7.2 Armandi Events & Travel Management will only issue a voucher to be used on another one of our tours if/should our Management team approve the cancellation request, for whatever reason it may be, of the specific situation. The voucher will only be issued when the cancellation was investigated thoroughly, or cannot be claimed by the client/travellers insurance company/policy and is subject to approval by our refunds department. No vouchers will be issued if cancelled for any reason whatsoever 60 (sixty) days prior to the tour or travel package commencement dates. The voucher can be used on any one of our tour packages within 24 (twenty four) months from the date the voucher is issued.

7.3 Armandi Events & Travel Management reserves the right, at any time and for any reason, to cancel the package, tour, event, activity or booking on or without notice to our clients. In such an event, Armandi Events & Travel Management shall refund the purchase to the client/traveller in the form of a voucher that can be used on any of our tours within 24 months, less our expenses. It is recorded that refunds as aforesaid shall be the sole responsibility of the client/traveller, and no claim for any damages, however Arising shall accrue against Armandi Events & Travel Management by reason of a cancellation of the tour / travel package. No cash refunds will be made.

7.4 Armandi Events & Travel Management also reserves the right to cancel any tour, travel package, event or booking for reasons of any Force Majeure less than 30 (thirty days) prior to the departure date. In this case the Client will be refunded in the form of a voucher that can be used on any of our tours within 24 months, less the reasonable expenses Armandi Events & Travel Management has incurred, and that will be the extent of the Armandi Events & Travel Management liability.

7.5 Our tours and packages require a minimum quantity of travellers in order for it to run. If this number is not reached, we reserve the right to cancel the tour or travel package. Armandi Events & Travel Management will try and not cancel this trip more than 30 (thirty days) days prior to the departure or tour, event, booking or package starting date, unless it is necessitated by the late cancellation of other travellers on the trip, unforeseen circumstances, weather related issues, Covid19, world pandemics or diseases, in which case it will be cancelled less than 30 (thirty) days prior to the departure or starting date. In this case, the client/ traveller will be refunded money they have paid to Armandi Events & Travel Management in the form of a voucher that can be used on any of our tours within 24 months and that will be the extent of Armandi Events & Travel Management liability less our expenses.

Indemnity

8.1 Indemnity Forms must be signed at the start of each activity/tour. It is compulsory that you take out insurance against personal accidents, medical expenses and baggage loss.

8.2 Armandi Events & Travel Management do not accept responsibility and shall be exempt from all liabilities in respect of any loss, damage, injury, accident that may arise from our Tours, Travel Packages, activities,sports,transportation, Events or Concerts. By booking and paying any of our products, this clause will immediately be in force.

8.3 The client/traveller agrees to comply with the laws and regulations of all the countries visited while on tour, and will comply with all reasonable instructions of the trip/tour/staff leader, driver or guide relating to the safety and organisation of the tour and participants. Any claims arising shall be subject to South African Law and the exclusive jurisdiction of the South African courts.

8.4 Armandi Events & Travel Management reserves the right to ban a client / cancel a client’s booking, tour, event, travel package or tickets in the event that the individual is disobedient to any of our staff, crew, trip leader, driver, guides or puts the lives in danger of any other individuals / clients. Armandi Events & Travel Management will not be liable for any costs incurred due to this matter.

Age Limits

9.1 All our tours are subject to Age Limits. Should you not be the required Age Limit you will not be allowed on any of our tours, packages or at events. We hold the right to cancel your tour, event or booking if you are not of the required age. Age limits are clearly indicated. This matter will not be refundable.

9.2 Children under 18 years of age need to be accompanied by an adult. Infants and toddlers are not permitted before 6 years old, except in exceptional circumstances and where prior permission has been obtained.

9.3 Any parties or alcoholic activities advertised by Armandi Events & Travel Management remain subject to age limit laws according to the respective Country. All alcohol laws are strictly abided to. Armandi Events & Travel Management reserves the right to ban a client / cancel a client’s booking, tour, event, travel package or tickets in the event that the individual is disobedient to any of these laws and puts the lives in danger of any other individuals / clients. Armandi Events & Travel Management will not be liable for any costs incurred due to this matter.

Photos, Videos, Social Media or Personal data

10. Armandi Events & Travel Management , its tour operators, staff and suppliers directly or indirectly reserves the right to make use of, without giving any notice, any photographer film produced, without payment or permission.

Conclusion & General

11.1 By booking and paying any of our tours and packages the client/traveller warrants/signifies that he/she has read and understands the terms and conditions / policies by the time of making, paying and or confirming a booking, event, tickets, tour or travel package.

11.2 The client/traveller also warrants that he/she agrees with ALL our terms and conditions / policies, covid19 rules and restrictions as per the governmental laws/guidelines of the country of origin where the tour/package will be commencing in/at.

11.3 In any event that dates, tours, bookings or any packages need to be cancelled due to Covid19 Restrictions or changes of laws not within our control, a voucher will be issued for the client/traveller to use on another tour, package or booking.

No full refunds will be allowed/made in this regard.

11.4 Armandi Events & Travel Management reserves the right to move/reschedule any tour, bookings, events and/or package dates without any prior notice, due to any unforeseen event/circumstances relating to the Covid19 Pandemic or Laws/by-laws that may arise at the time or after making, paying and or confirming a booking, tour or travel package. It remains the client/travellers responsibility to ensure that they regularly keep track of the laws and regulations of this pandemic.

11.5 Armandi Events & Travel Management , its servants,its agents and suppliers shall not be responsible for and shall be exempt from all liability in respect of any loss, damage, injury, accident, death, delay or inconvenience to any person, or his or her luggage other personal property, whenever the same shall arise from or be occasioned by the negligence of Armandi Events & Travel Management, it’s partners, associates, servants or agents or other person directly or indirectly in the employment or service of Armandi Events & Travel Management or under any circumstances whatsoever.

11.6 All terms and conditions of our laws, suppliers, hotels, agents, attractions, activities, hiking trails, parks, safaris, transport, tax, levies and medical requirements should be adhered to at all times. In the event that any clients or travelers misbehave or disobey any rules or terms and conditions / policies we hold the right to cancel your tour, booking, activities, events, concerts or packages of any sort and ban you from the itinerary. The traveller/client will be solely liable for any costs and liabilities this may occur and signify that Armandi Travels may deduct such costs from the saved payment/card details on the clients profile without notice.

11.7 Should any client/traveller damage, or cause damage to any properties/tourism sites on the tour or of the tour operator such as equipment, vehicles, boats, electronics or any item not mentioned that is the property of Armandi Events & Travel Management , its suppliers, associates directly or indirectly and staff on purpose or through negligence, the client/travellers will be held responsible for the cost to repair or replace such damaged property in full. In this regard the client/traveller gives Armandi Events & Travel Management the right to charge/collect these monies to/from any payment information saved on our database of the client/traveller without any notice. Armandi Events & Travel Management will in writing inform the client/traveller of the fees and provide necessary proof thereof.

11.8 Armandi Events & Travel Management , its servants, its employees, its agents and suppliers shall not be responsible for and shall be exempt from all breakage costs, vandalism, arrests or misconduct from any of our clients/travellers.

11.9 The use of our website following the posting of changes to our terms or conditions / policies will mean that you also accept those changes and updated terms as well. It remains the client/travelers responsibility to regularly inquire or check if any changes/updates were made. Armandi Events & Travel Management will not be responsible to notify or inform the client/travelers of any such changes. By using our website, you signify your acceptance of our Terms & Conditions as well as all our other policies.

Customer Privacy Policy

12.1 Armandi Events and Travel Management shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.lawsofsouthafrica.up.ac.za/index.php/current-legislation.

Country of domicile

13.1 This website is governed by the laws of South Africa and Armandi Events & Travel Management chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, Cape Town, South Africa.

Variation

14.1 Variation (Your Company) may, in its sole discretion, change this agreement or any part thereof at any time without notice.

Note: Before booking or purchasing any of our trips/tour packages or events it is your sole responsibility to contact the Embassy in your country of origin and ensure that you are able to obtain a visa / any travel related documentation for the specified dates of the tour, event or package you are purchasing !! Armandi Events & Travel Management , its servants,its employees, its agents and suppliers shall not be responsible for and shall be exempt from this matter and no refund will be granted for incorrect booking
